this is kpix5 news. >> it was a winable battle to save an indispensable bait. one of america's darkest days in afghanistan, a bay area soldier named ty carter fought back. good evening, i'm elizabeth cook. >> and i'm ken bastida. staff sergeant carter will get the metal of honor and joe vasquez tells us, that makes antioch home to a hero. >> there is no dad that i know of or ever heard of that has this experience. >> a very proud dad. mark carte says he is thrilled to hear the news that his son, ty carter, will soon receive

the nation's highest honor. carter spent his childhood here before moving to spokane, washington. he moved back here to antioch for a few years as an adult to live with his dad and step mom, barbra, after he got out of the marines and before he rejoined the military this time in the army. >> not too many guys get to experience this. or their son and daughter survive. and then gets recognized. >> he was very proud. >> gets recognized nationally. gets recognized nationally for an act of being himself in a down situation. >> october 3, 2009, the taliban recorded their own video of the ambush. 400 taliban fighters had the high ground. the taliban rained down rocket propelled grenades and heavy fire. ty carter was a member of b

troop, third platoon. he braved enemy fire to run ammo to his fellow soldiers. a sniper had everyone pinned down. rescue one of his friends who was bleeding to death. the americans managed to stave off the enemy, but eight lost their lives. ty had only been in afghanistan a few months before the battle happened. his dad says despite the recognition, his son still doesn't consider himself a hero. >> he is learning how to be better at it, but the first few times, what? >> he doesn't consider -- >> he doesn't consider it. no, he doesn't recognize it. >> he did the best he could in a bad situation. >> ty carter will receive his metal of honor from the president in a ceremony at the white house next month. for now, he is in fort lewis, washington, in the state he considers his second home. >> you know, you read about these guys who are metal of honor recipients and they all fit this pattern. they are just regular guys who, when called upon, do

extraordinary things. here's a kid who bumps around a little bit, gets out of the marines. >> his dad says he was working odd jobs and a fish out of water here in the bay area. got right back in the army. within three months, he's in for the fight of his life. >> and the bay area is proud of this guy. >> absolutely. >> all right joe, thanks very much. >> in nine days, bart workers could walk off the job again. both sides have until midnight, sunday, august 4, to reach an agreement. so far, both sides remain pretty far apart. and just tonight, the unions claimed bart's chief negotiator has a conflict of interest. kristen ayers looked into that, and yes, it looks like he does. tonight, bart is shrugging this off. >> bart hired tomahawk to help them avoid a bart strike. but it turns out, hawk also

works for another company and that company made money off the bart strike. >> thomas, who is the lead negotiator for bart, has a direct financial interest in the occurrence of a strike. and he has a direct financial interest in a prolonged strike. >> today, union leaders filed this complaint, accusing hawk of a conflict of interest. the problem, hawk is the vice president of labor relations at a company called viola transportation. these invoices obtained by the unions show that company brokered two contracts worth $30,000 to supply shuttles during the bart strike. >> that is directly in conflict with his duty to bargain in good faith with the union. >> bart officials insisted today, hawk's company received only a small fraction of that money. >> he was only paid $500 total. $250 on each of two contracts as an administrate i administrative fee for this

service. >> do you believe it's a conflict of interest? >> we do not. >> $500. >> that's still money, though. >> we don't feel there's created conflict. >> the own code of conduct, when the contractor is unable to provide impartial and objective assistance or advice to the district due to other activities, relationships, contracts, or circumstances. a standard that the unions say hawk's situation meets. >> we're calling upon the board of directors to immediate investigate this conflict of interest and order him to be removed from negotiations. >> i have been told he'll stay. >> mr. hawk was hired for $300,000. i reached out to the president of the bart board of directors and he did not return my call tonight. >> kristen, earlier he was under fire for going on

vacation, now it's a potential conflict of interest. are they going to have to find alternate ways to go to work? what does this mean for the negotiations? >> it could certainly have an impact on negotiations. the unions are plotting their next move. they are willing to take legal action if he is not removed and that could certainly put a wrench in things. >> all right, kristen, thank you. and thankfully, it doesn't look like this anymore. it took hours, but traffic has recovered after a complete shutdown at the bay bridge. cars stacked up at the toll plaza and in the city. it's all because of a suspicious device was found. the bridge was closed in both directions for about half an hour while the bomb squad removed the device. still, no word on what it was. >> the new span of the bridge is getting a temporary fix. crews are placing steel plates to help stabilize seismic

safety devices under the bridge. and if the shims work, the new bridge could open a lot sooner than the new, but still tentative opening date of sometime in december. >> these wedges are going in to protect the bearings. but there are some who believe that would give us enough stability to open the bridge sooner and not wait until the permanent fix is completed. >> crews will continue to install the permanent saddles. the new bridge was supposed to open on labor day. there is no officially opening day set. people in oakland say it feels like they are living in a war zone. there may be some truth to that. behind flint and oakland. the 2012 crime report. recent violence has neighbors in oakland ready to fight back. >> it is time for us to take back our city. take back our streets.

mysterious hundreds of americans in seven states are sick. they are suffering from mysterious stomach bug linked to imported produce. dr. john says for the fda, it's the final straw. >> nearly half of the nation's fruit and 20% of vegetables come from abroad. right now, when one of those product comes here. how is it inspected? >> right now, we rely on the fda. >> fda screens less than 2% of
